Eligibility for intervention Under the Academies Act 2010, the Secretary of State has the power to make an academy order in respect of a maintained school in England in the following circumstances: a) If the governing body of the school makes an application under section 3 b) If the school is eligible for intervention (within the meaning of part four of the Education and Inspections Act (EIA) 2006). The issuing of an academy order under a) requires the school’s governing body to decide to apply for an academy order. However, option b) doesn’t require the governing body’s consent and represents “forced academisation” in its purest form.
